DJ Talent Agreement
This is an agreement between Ric Hansen Entertainment Inc. AKA Radio Parties, herein after referred to as the client and The DJ identified below, herein after referred to as performer. Its purpose is to articulate the specific terms by which their business relationship shall exist. The undersigned agree that this agreement will cover all performances subsequent to its signing.
Performer will provide all lighting, sound and the music library appropriate to each specific engagement
They will maintain their equipment to provide a reliable high quality show free from technical malfunctions. They will keep their music library current in the musical genre that they are performing. As a host and MC, performer will be responsible for orchestrating contests, giving away prizes, making announcements on behalf of the client and any other host related duties necessary to make each event a special occasion for the client and their guests.
Radio Parties: When performing an event on behalf of Radio Parties, performer will represent only Radio Parties, their radio station and commercial sponsors. There should be no mention of performers independent business or even that one exists. For the time performer is employed to provide entertainment on Radio Parties behalf, they are a sub-contracted employee of Radio Parties only. Violators are subject to termination of future contracted events and no further booking opportunities. Radio Parties reserves the right to spot check events to confirm agreed upon representation.
Commitment and confirmation of events: When event becomes available and performer is contacted by Radio Parties they may accept or reject that event at that time. If they accept the booking they are committing to that event despite the temptation of subsequent opportunities that might present themselves; independent of Radio Parties. Radio Parties will follow up with specific information by mail for each event, time permitting. If performer is undecided at the time of the telephone contact, Radio Parties has the option to continue to try to employ someone else, until performer has given us a firm confirmation.
Client Contact: Performer will contact the client directly on the Monday or Tuesday prior to a weekend event; no less then three days before performance. The purpose of the call is to: introduce themselves, confirm times, get directions, discuss last minute changes and probe the clients specific expectations. If the confirmation call is not attempted by 8am Wednesday prior to the performance, Radio Parties reserves the right to re-assign that show to another available DJ.
Again performer in their phone contact with client, should represent only Radio Parties. (If questions arise regarding other Company names on answer machines and voice mail…simply identify that as your day job or other generic responses without getting into how that company name interacts with RHE.) This is important to avoid confusion and uncertainty by our client.
Promotional /Marketing requirements: Radio Parties is a promotions company. We represent radio station sponsors and commercial sponsors. Most Radio Parties events require signing, prize giveaways and Sponsor announcements to be made. It is vitally important that the performer is clear on what is expected of him in each of these areas for each event. The information should be included on the DJ worksheet and /or discussed and arranged in advance by Radio Parties personnel. Radio Parties relationships with sponsoring radio stations, and advertisers is critical to our on going success. The commitments that have been made to Radio Parties sponsors are the performers responsibility to flawlessly execute at each event. Performer should be clear about what promotional signing and activities are expected at each event. It’s the performer’s responsibility to have a crisp, clean looking show with care taken in sign display.
Conduct: RHE has entered into this business relationship with performer based on their respect for performer’s reputation for high performance and ethical standards. As review, however, it should be pointed out that any illegal, or unethical activity engaged in by performer will be grounds to dissolve our relationship without notice and all subsequent events would automatically be cancelled. In addition, drinking or smoking anywhere on the grounds of a youth event or prior to a youth event is strictly prohibited. Drinking at any event, although not prohibited, is discouraged and, if done at all, should be with great discretion.
►Fraternizing with guests at any event is strictly prohibited.
►Use of sorted language is always in poor taste and is not acceptable.
►Lyric content in music we play should be monitored very carefully to avoid overtly sexual or violent lyrics. It is ultimately the performers responsibility to screen all music that is played.
►Performer should restrict guests to working support staff.
This conduct code applies to performers support staff or guests. Performer takes full responsibility for anyone whom they have invited.
Radio Parties Promotion: At each adult event DJ should take a few minutes prior to start of their event to:
1. Have Radio Parties flyers (appropriate to your event) displayed openly on the DJ console.
2. Without exception at each event there should be 2 verbal mentions made over the microphone that if someone is planning another party or event, that tonights entertainment is being provided by Radio Parties. These mentions should be made toward the beginning and toward the end of each event.
3. Have Radio Parties business cards and, when asked, always have a card and brochure for the guest.
Event promotions is such a vitally important aspect of our business, this is not a casual request, but mandatory at each event.
Quality control personnel will regularly spot check DJs for execution of this important part of our business. We expect 100% participation at every event. It is the DJs responsibility to advise Radio Parties office staff to replenish supplies.
Referrals: When Radio Parties receives a referral from one of performer’s events, that performer automatically gets the referred event. If performer is not available for that event we will try to arrange another event for the performer in appreciation of their great work and referred new business.
It is appreciated but not required that performer will refer business that they are unable to perform from their independent business, to Radio Parties, in return Radio Parties will make every effort to arrange an event for performer on a date when performer is available, in appreciation.
Event report: Any time after the event, performer will be responsible for calling Radio Parties with a report on the dance event, this can be done either during business hours or a report may be left on voice mail. The report should indicate how the dance went, if anything unusual took place, if there were any technical or security problems. Radio Parties checks with each dance client after the event and must have your report before we contact the client.
Compensation: Performer will agree by telephone at the time of confirmation to the amount to be paid to him for a given performance; which will include any known overtime, or travel expenses. That amount will be paid to the performer on the Monday following the event but only after having received the performers event report by telephone. If performer collects funds from the client on our behalf the date of the performance, that money must be delivered in person or by mail on the Monday following the event. Radio Parties reserves the right to withhold DJ payment until we receive their event report and/or the funds they have collected. Radio Parties further may withhold all or part of the compensation for a dance event if the client withholds payment for reasons that were clearly the fault of the performer.
Overtime: Performer will be paid $50.00 per hour for each additional hour after the first four hours. If the overtime is arranged in advance that will be included in the originally agreed upon fee. If however, the client requests overtime at the event you should get that agreement in writing (Radio Parties has forms available, or any note with a signature of the contact name would be acceptable.) They should be told that they can be billed for the additional hours or they can pay you directly. In order to assure payment of overtime to performer, performer must provide Radio Parties with a written verification of additional hours from client. We will be in touch with all clients on Monday following the event so well be able to discuss the overtime arrangement with them then. Make sure any overtime information is included in your report to our office after the event. Keep in mind the Radio Parties bill-able rate for overtime is $75.00 per hour. Performer should let the client know that that is the rate they are agreeing to. (The overtime fee information is included in the contract they have already signed.)
Tips: Although Radio Parties doesnt encourage or discourage client tipping to performer it is a completely acceptable form of appreciation and thanks for a job well done.
Cancellations: If a client cancels an event with less then one weeks notice Radio Parties will attempt to reschedule performer for another event for that same time, if not, Radio Parties will attempt to replace the revenue with a non prime time event (weekdays, or afternoons) as compensation. If neither is possible and this was a prime time event (weekend nights) we will pay a cancellation fee to performer of $100.00.
The Cancellation policy does not apply if cancellation is due to an act of God, including, weather related cancellation, fire, flood, earthquake etc.
Evaluation: Each client will be asked to provide us with feedback from their event. Each evaluation returned to Radio Parties will be copied and sent to the performer, so they can get instant feedback on their performance. Radio Parties uses feedback forms as one way to get continuous feedback on performers. Performer should never contact client regarding information on the feedback form. If you have concerns or questions, please contact Radio Parties. In addition, Radio Parties personnel will randomly spot check events.
Contract term: Ongoing or until either party chooses to discontinue the relationship. If the relationship is dissolved for what ever reason, Radio Parties reserves the right to cancel performers events and reschedule other performers. All banners, signs, prizes, coupons or other promotional materials held by performer will be returned within 5 days of termination of relationship. Failure to do so may result in legal action.
Performers obligations: Performer is responsible for their own Insurance for theft, comprehensive and personal liability. We do carry a liability policy for emergency purposes. In addition, as an independent contractor they are responsible for their own music licensing and fees, including Business licenses, with city, state and federal authorities. They will be responsible for claiming their own income for Federal Income taxes. Radio Parties will provide 1099 forms no later then January 31 of each year for the previous years income.
Performer agrees not to contact or become involved in any way with Radio Parties sponsor radio stations or commercial sponsors unless agreed to by Radio Parties. Performer also agrees not to reference, Radio Parties radio stations or commercial sponsors in promotion of their own independent business either verbally or in print.
